What changes at 50 employees
- The ACA employer mandate. At 50 or more full-time employees (including full-time equivalents) you’re an applicable large employer. For 2027 the annual penalty amounts are $3,780 per full-time employee (after the first 30) if you don’t offer coverage to substantially all of them, and $5,670 per full-time employee who gets a Marketplace credit because your coverage wasn’t affordable or didn’t provide minimum value. [IRS Rev. Proc. 2026-22]
- Affordability for 2027: 10.22%. The employee share of the lowest-cost self-only plan that provides minimum value is tested against 10.22% under IRS safe harbors (W-2, rate of pay or federal poverty line). [IRS Rev. Proc. 2026-26]
- Reporting. Applicable large employers file Forms 1094-C and 1095-C each year.
- Large-group market. Michigan’s small-employer definition stops at 50, so above that, fully insured pricing reflects your own group’s experience. [MCL 500.3701]

Frequently asked questions
When does the ACA employer mandate apply?
When you have 50 or more full-time employees, including full-time equivalents. For 2027 the annual penalty amounts are $3,780 and $5,670 under the two parts of section 4980H, per IRS Rev. Proc. 2026-22.
What is the 2027 ACA affordability percentage?
10.22% for plan years beginning in 2027, per IRS Rev. Proc. 2026-26, up from 9.96% for 2026.
Should a 100-employee company self-fund?
Some should and some shouldn't. It depends on claims stability, cash-flow tolerance, stop-loss pricing and how actively you want to manage the plan. Level funding is a middle step. We model it with your data before you decide.
Can we use ICHRA for only some employees?
Yes. You can offer a group plan to some classes and an ICHRA to others, such as full-time vs. part-time or by work location, subject to minimum class-size rules.
